A SPOKESMAN for the CPS said Tracey Harper was not prosecuted as she had not technically broken the law.
He said: "The illegality in prostitution is the advertising of sexual services for money. In this case, the complainant agreed to provide her time to the defendant for £120 per hour.
"Whatever else was agreed was private between the parties, but the agreement he failed to honour was for her time, which is not prostitution and not illegal."

PROSTITUTION itself - exchanging sexual activities for money or goods - is legal in the UK.
However, many of the activities which prostitution involves are illegal under acts including the Sexual Offences Act 2003 and Street Offences Act 1959.
It is illegal to pay someone under 18 for sex. Anyone, male or female, on the street can be found guilty of soliciting for the purpose of prostitution under the Street Offences Act 1959.
It is also illegal to persistently solicit anyone on the street for the purposes of prostitution. Working indoors, alone or for an agency or in a brothel is legal provided the worker is at least 18.
